   Digital depictions of nudity present a unique challenge–AI can be used to create realistic images, and it can be hard to distinguish between digital art and photography.

   Most art sites have a stipulation of "if we can't tell, it's treated as real." The current flip flop is just going to confuse people and cause undue stress and accidental violations by people meaning well.

   Images that are primarily real-life photographs, regardless of the use of filters or photo editing (*)

2. Number the policy/guidelines and having clear details in enforcement emails

   I have recommendations that not only helps users, but more importantly protect TWITCH itself.

   • Number the policies into clear enforceable points(e.g. policy SC-2b-iv)
   • In enforcement emails, show clear timestamps that shows the violation and quote the policy number violated using the numbering above.

   Making the policy itself is a difficult, intricate task which requires multi-faceted considerations that may be obscure to the general user. Thus I trust twitch has qualified specialists for the actual policy creation. However vague ENFORCEMENT leaves the corporate vulnerable to public image attacks that is extremely dangerous especially for a corporate which depends on advertisers. Clearly communicated, consistent enforcement will protect TWITCH, and show integrity to users, stakeholders AND advertisers.

   Numbering the policy could also help fix internal references. For instance in the Civility and Respect FAQ the "sexually suggestive content policy" is mentioned but is no longer called as such, so it can't be found easily. It could instead be a policy number hyperlink.

   Here's an example of how I would suggest enforcement:
   "Hello akuasmr. At 18:05:00 of your 12-06-24 stream, we detected "prolonged audio that implies sex" mentioned in Policy SC-2A-iii." (images: https://twitter.com/Rhubarb_314/status/1736039641726210196)

   Here I used a vague 'implication' type policy here on purpose, because it shows how it also opens the court to clear, transparent, respectful dialogue. Akuasmr can now contest upon clear understanding, instead of possibly defaming twitch on social media which would not serve twitch.

   Another positive to numbering the policies is the ability to track issues. Community strikes and bans can then be tracked by what policy violation it was based on. This could be compiled into extremely valuable feedback statistics to inform policy makers of any arising issues. For instance if there is a spike in SC-7 (Prohibited Gambling Content) violations, it can automatically raise a warning to allow moderators to take actions quickly.

   Whatever the case, I only wish the best to Twitch and all the amazing content creators on twitch.

   Regardless of where your policy makers choose to take it, I hope this suggestion will help protect the relationship between users, advertisers, shareholders and Twitch and its policy makers!

3. Allow Female Presenting Breasts/nipples

   There's nothing inherently wrong with women (including those who identify as women and female presenting people) with having breasts/nipples.

   We all as humans have nipples. Just because someone is a woman, that does not mean she should be required to cover herself while men are allowed to be shirtless without them being shamed for it.

   There are women with very little b r e a s t tissue as well as men with enlarged chests (for example gynecomastia or simply being overweight).

   If a streamer (regardless of gender) obviously sexualizes themselves on stream (such as groping, sexually moaning, imitating or performing sexual acts, etc) they should be penalized (or there should be a separate section entirely for these particular streamers that requires age verification from viewers and creators to access).

4. Permaban female streamers habitually sexualizing their streams.

   You cant avoid this stuff. You go to twitch's front page and you see women clearly showing as much boob as possible without it being pornographic just to draw in ***** viewers. It's a game to them, how far can they push the line without breaking the rules.. Full screen cam with no game being played. No art being done. 5. Sexual Content Policy Update

   To Whom it May Concern at Twitch and whoever else decides to read this,

   While I am not someone who streams on Twitch, though have considered it, and who rarely finds myself watching streams, I still had been rather excited for the recent, now declared null, update to the TOS/Policy on Sexual Content.

   I am not someone who participates all that often in adult content, but I do believe that it should be able to exist in adult spaces for those who do wish to participate. The internet has become a hostile places for those who wish to see or participate in adult spaces, which in turn makes it harder to create safe adult communities with proper monitoring and safety in mind.

   I do not believe the sudden take back of the content policy change was the right thing to do. If anything I believe the best thing Twitch could have done was instead move in the direction of banning the machine learning(AI) content that was mentioned as a reason behind this rollback because of the whole "not being able to tell because of how lifelike it is."
   If there is an obvious problem area — AI content — then that is what should be focused on, not a blanket ban on content. Especially when you readily admitted that most of the content was in line with the new policy and that any content that wasn't was dealt with accordingly.

   Censorship does not work in the way that most people and companies think it does. The only thing censoring content, especially fictional content, does is tilt in favor of those who wish to use the censoring to get rid of anything they do not like, and honestly starts to feel like we're toeing the edges of certain ideals(fas cist) and that we're trying to reinstate the Hays Code <-- something people should look up to learn about why this isn't the way we should be going.

   While I understand the concerns of some people wanting to keep adult content away from minors, and not wishing to see it themselves, there are a few things that they should keep in mind:

   1. It is not the responsibility of adults who create adult content in adult spaces to cater or to look after kids that appear in those spaces. This is entirely the responsibility of the parents, and to an extent the website, to do and prevent.
      If you are afraid that seeing such things will "corrupt their minds" then that sounds like something you have to deal with in yourself, and is also in your responsibilities as a parent and adult to teach your kids about internet safety and sex education.

   2. Online isn't just for kids and adults shouldn't have to give up their spaces for kids. We're allowed to exist and do adult things and we shouldn't have to worry about kids breaking OUR boundaries to access OUR spaces.

   3. If you don't want to see it then don't watch it. No one is forcing you to watch the things you do not want to see.

   4. In my experience online most anyone that has a "think of the children" mindset usually doesn't actually care about kids and is using the kids as an excuse to attack the actual thing they don't want to see. If this is not the case then all my points still stand. If it is, then you should probably have a think about what it really is that you're against and why. Your disgust is not a measure of morality.

   ---

   Now, onto what I think Twitch should do:

   1. Separate the adult content from spaces where minors can view or access it. This is not the same as removing it completely.

   2. Create a proper block/blacklist/filtering system that allows people to remove content tagged with certain labels and mature ratings from their feed entirely so they do not have to see what they do not want to.

   3. As an addition to point two, be vigilant and dedicated to making sure that people tag/rate their content properly so the tagging and rating systems work properly.

   4. Be transparent about what adult content is allowed on twitch. As in if you say fictional adult content, be sure to make it clear that all fictional characters must be over the age of eighteen, which I am sure was/is already a rule, but better to restate it than not. Also add examples of allowed content.
      This kind of thing can be tricky though as you cannot really discern age of someone off appearance alone. Example being I just turned thirty and people think I am younger than my sister who is four years younger than me. Or that there are many people who are adults but have small chests or small stature.

   5. Actually have a plan and be ready for the influx of content when you make sure changes to your site. As mentioned previously, most of the internet is a hostile place for adult content so when someone gives the ok to such, there will always be those who push the boundaries to see what is and is not allowed — be transparent about what is ok — and as long as you monitor it then everything should be ok. Of course the beginning will be a bit rocky, but things never start out going the exact way we want them to go, and running away does not allow progress to be made.
      Hire more moderators and pay them fairly for their work.

   6. Remove machine learning(AI) ccontent if it is such a problem that one cannot tell if it is real or not.

7. Re-evaluate Partners Periodically

   Many Partners flippantly break Twitch's Terms of service, many telling others to do so, in the process. If these are meant to be pillars of the community, they should uphold the standards better than anyone. Instead, they coast on their status to avoid anything beyond a 24-hour ban. This shows that they are not being held to the same standard as the rest of the creators on the platform. Partners who knowingly break the Terms and continue to do it when corrected should be stripped of Partner status.

8. Change the labeling of non-sexual nudity (real and artwork) to Nudity rather than Sexual

   Simple nudity is not sexual in nature in real life and in artwork. It's clearly not appropriate to classify know classics as sexual - even NSFW or Mature. Example: Michalangelo's "David", etc. Even Facebook stopped censoring such works. Content creators should submit things for review when there is uncertainty and simply.
   So labels Nudity, NSFW, and Classic Art should be added to the list. Sexual should remain a category if mature conduct or erogenous focus is the theme.

9. Hate Raid Mass Report Response

   I noticed a lot of hate raids will flag / report a channel rapidly to get it taken down; and it had me thinking about Steam Review Bombing.

   I was wondering if a possible fix might be that if a channel gets an exceptional amount of flags / reports in a short period of time that those reports are thrown out or logged as possible hate raid? Might allow your automated systems to avoid banning streamers in these situations while not removing the ability to still report content.

10. make an 18+ twitch website

    Make a Twitch website that's 18+ only, possibly with more lax moderation and rules.
    One that's similar to twitch, but it's 18+ and it's a separate website. It's unlikely that there would be any monetary loss, long term. Quite the opposite actually.
    Twitch is already considered somewhat of a shady **** site, so it would have no bearing on their reputation.
    The only difference would be that the 18+ content would get its own twitch website and would thus be separated from the regular content and make the main Twitch website predominantly for gaming again.

11. Art Category seems no longer Art.

    Recently, due to the introduction of NSFW content on the platform, more channels have been appearing in the ART category.

    I, as many other artists in this platform, understand there's a community within NSFW artists, which is much appreciated. What should be not permitted are channels advertising themselves in the ART category, misleading people to a content not related to art.

    There are more than 20 accounts, during the hours when the audience is lower, streaming nude real girls twerking and other different +18 content as well. I presume, in the higher audience hours, these accounts may increase in number. There are also people using AIs to create from nudes to pornographic images, not to say that is not art and those accounts didn't exist before, they have just appeared in our category due to this new policy.

    The art category has been there for years, for people streaming and watching Art, and our beloved space has turned into a bag for those who don't know which category they should be streaming in, making it quite uncomfortable.

    I would encourage TWITCH to do something about it, introducing an NSFW Category wouldn't be a bad idea. Even a new category for those using AI, allowing the art community to remain safe and restricted to artistic practices.
    Art Category shouldn't be the place for everyone to go when they don't know which category they should be in.

    As a further recommendation, and to be close to what people stream, have you ever think about subcategories? That would be a way to solve this issue, even welcoming more people to the Art community.

    The art category could have different subcategories such as digital art, traditional art, body painting... So that people appear automatically in the one they belong, also allowing them using all hashtags to be even more specific.
    Hoping for the best solution for everyone in the twitch community to be applied.

13. Stop Automatic Bot Suspensions Before Human Review

    The just updated community guidelines have highlighted a massive issue in how you handle community reports. There have been many streamers who have streamed in accordance with the new guidelines around sexual content relating to art, and almost all of them have been suspended. Some have been suspended, had their suspensions lifted, and then had the bot slap it back on, all for literally working on the same piece of art. This is no less disruptive than the hate raids we had to deal with a year ago, only it's worse because these are messing with people's ability to earn a living.

    Something as serious as a suspension needs human review before it's allowed to put a stain on a user's account. There also needs to be action taken against accounts that mass report others without just cause and those who encourage such action. They are driving away the exact creators you claim to want to help with these modified guidelines.

    Ever since the new guideline changes have been announced, a flood of streamers drawing and watching hentai on twitch has emerged. some of them not even using labels. this can be VERY harmful to minors to log onto a site with a new account only to see *. while i do agree that artists deserve more freedom to do things like anatomy and actual artistic nudity, its not a great idea to have * full of minors. much like myself. Ive also seen people playing hentai games and using sex mods (like the jenny mod for Minecraft) while on stream. Its also somewhat common to see lewd art plastered across stream overlays.

    I dont wanna move platforms to somewhere like youtube due to twitch simply having better features.

    This technically still hides content creators away and will not let the people who do want to see that content in their own home page enjoy what they like.

    so creating a toggle that allows people to individually see that content classification label - content should be made, specifically if it ever comes down to creating parental controls in the futures it'll be useful for even the Twitch App.

Which should be clarified.

    the way you defined Nudity was confusing to those that perform / create art of such kind because with the appropriate Content Creation Labels you can draw Buttocks, Groin, Breasts regardless.)

    you still don't allow but you now allow only for Body Artists & Erotic Dancers, buttocks and the top half breasts only due to your attire and nudity guidelines.

    so as long as this remains unclear you will confuse people and Users will get banned in the confusion.

18. Option to filter out Sexual Themes

    While I believe that creators should have some freedom to do what they want, I also believe viewers should have the freedom to exclude certain content from their searches on Twitch. As is right now, I cannot find a way to filter out streams marked with "Sexual Themes" through the search bar on Twitch. Simply searching the word "art" brings up any stream with the "art" tag, which could be a stream with the "Sexual Themes" CCL.

    In fact I just did this, the top 5 results included two streams of IRL streamers in barely any clothes, dancing in a sexual manner. These streams are both marked as "Sexual Themes". Whether or not you consider that to be art isn't the issue; viewers should have the ability to filter out any content they don't want to see from the start. This should be one of the first things people do when they create an account.

    (This mainly considers viewers who are 18+; there are some adults who would rather not see certain themes. I don't have a suggestion for viewers under 18, that's something your legal team needs to quickly work out.)

19. TOS clarifications, hiding, and image-based guidelines

    Twitch,

    Firstly, let me clarify to you that I enjoy artistic nudity and am not a puritanical person. I also want to clarify that some people who didn't deserve to get banned got banned today who didn't draw any genitalia and who abided by the new TOS, and that you need to fix your accounting.

    However, this is regarding the "opening of Pandora's Box" that you have willed over the course of a singular day.

    Whether I like their art or not, the "sexual content" warning isn't sufficient, there absolutely needs to be (1) a censored thumbnail for 18+ streams (such as the drawing of NSFW art, as well as (2) two separate categories hidden from view and turned off from default view for minors. These would include a NSFW art subdivision and "tasteful nudity" subdivision.

    There are obviously still risks with this, but this is better than going into the situation with a half-baked plan. (3) Ideally, they should require credit card verification or some other form of ID, but if that's not possible, even having the other two is fine.

    From what I can surmise just glancing on my homepage yesterday, your algorithm doesn't launch mass suppression like Twitter and it certainly doesn't prevent minors from seeing this content, at least in the thumbnails. I can tell you this as a certainty because some people (not minors) from my Discord have already complained to me about this, that you can see it without any account.

    Let me give you the long and short of if: If the media frenzy is any indication, it's only a matter of time before Twitch has some articles written on it by neurotic journalists regarding its failure to protect children. This might even result in Twitch getting restricted in other countries in the future. That is, unless you put up appropriate safeguards

    You need to commit to the three recommendations above or immediately roll back your ToS change until it can be properly implemented, headache as that may be. This is not calling for a blanket ban, it is calling for sanity. You are risking the realization of the slippery slope. I think this art should be allowed to stay if at the very least it is properly separated into a different category that only shows up for a certain age range, there is thumbnail censorship on top of the warning, and ideally (I know this one is difficult to implement and more of an ideal) age verification.

    You are a gaming platform, not DeviantArt or NewGrounds. Have some integrity and actually plan these things out.

    In addition to the above three points, please also stipulate clearly and explicitly (and not imply) that artistic nudity does not include (1) sexual *********** or (2), masturbation. This has been a topic of contention in every stream that I have visited yesterday and it needs to be dealt with. You should also have images of what is and isn't allowed in a cartoon format for creators, just the outlines of two oversimplified characters having sex, same as the ones you could find on Healthline.

    For non-18+ drawing streams, I believe you should also clarify that drawing characters without any nipples or genitalia as part of the drawing process when first outlining, sketching, or coloring is fine. That's probably the lion's share of complaints from SFW artists anyways.

20. Tobacco, Alcohol, and Mariuana belong under the same classification as drugs

    I have seen less and less ads around alcohol on twitch which is great its good to see a company pull away from those advertisements as Alcohol is a form of drug it contains ethanol and should be classed under the community policy regarding drug use, tobacco is in the same exact boat as alcohol its classed as a drug since one of the main chemicals in tobacco is Nicotine so its a given that Alcohol, Tobacco, and Marijuana should be classed all as drugs instead of it just being marijuana as the two aforementioned drugs are highly toxic and dangerous. Just because we as a species have been consuming both Alcohol and Tobacco for so long shouldn't mean that they should be categorized as non-drugs but if classifying them as drugs is a problem then replace it with controlled substances.
