Or promote them to Global Moderators because they are effectively doing your job for you.

For those who don’t know the difference:
A Twitch Global Moderator is someone hired by Twitch to process your personal information and track your usage of the platform.
A Channel Moderator is any random idiot chosen by any streamer to process your personal information and track your usage of the platform.

The difference is as follows:

The first represents Twitch and is legally required to be responsible with your private information (according to California’s Online Privacy Protection Act).

The second represents a private business that is affiliated or partnered with Twitch that is not legally required to do anything nearly responsible with your private information.

THEY ARE HOWEVER, STILL REQUIRED TO FOLLOW TWITCH TOS.

It’s very clear, Twitch:

9. Prohibited Conduct

YOU AGREE NOT TO violate any law, contract, intellectual property, or other third-party right; not to commit a tort, and that you are solely responsible for your conduct while on the Twitch Services.

You agree that you will comply with these Terms of Service and Twitch’s Community Guidelines and will not:

i. create, upload, transmit, distribute, or store any content that is inaccurate, unlawful, infringing, defamatory, obscene, pornographic, invasive of privacy or publicity rights, harassing, threatening, abusive, inflammatory, or otherwise objectionable;

…

v. defame, harass, abuse, threaten, or defraud users of the Twitch Services, or collect or attempt to collect, personal information about users or third parties without their consent;

xvii. use the Twitch Services for any illegal purpose, or in violation of any local, state, national, or international law or regulation, including without limitation laws governing intellectual property and other proprietary rights, data protection, and privacy.

If you hate reading here’s the summary.

It is explicitly against ToS for channel moderators to go “above and beyond” their self-appointed station to collect your data for the purpose of baring your use of the Twitch service.

It is not their right and it is in violation of yours.

Twitch does nothing to stop this as it has no legal repercussions on them.

If you don’t think it’s happening, ask your favorite streamer what moderator guilds (another thing against ToS) they are a part of.

Or better yet. Just ask them about the users they have cross-banned themselves.

I personally do not have a quarrel with people having subathon's, though I do hope that they make every effort to maintain a healthy schedule for sleeping, eating, self-care, etc. I do feel that it is potentially misleading to some and saying the stream will perceivably "last forever" (as long as people continue to donate/sub) but then during stream announcing when the streamer will cap/limit the subathon, thus contradicting bot announcements and stream titles lacking or having omitted the now annouced limit to the stream. if people continue to donate or sub in effort to continue the streams timer, but the stream has a definitive end, the donating member has been presumably mislead and is now not getting what they were intending to pay for?
I think it's a miniscule microscopic margin of people that would potentially be petty enough to bring this up, and I had difficulty finding actual legal support or information on this at all, but I would hope to avoid this for anyone and am curious what, if anything, could be done to better help content creators regarding this?

Just like you created the new Category, "Pools, Hot tubs, and Beaches" because of the excessive demand, you also NEED to create a "Troll Jail" for all viewers who abuse, harass, or 'troll' your Twitch Streamers!
The number of Trolls have become quite excessive, and simply 'banning' an abusive viewer from a single streamer, ONE, that banned viewer can still see and hear the streamer, TWO, that viewer can jump into another streamer, and continue his\her harassment!
You need to create an algorithm that bans that viewer COMPLETELY FROM TWITCH! Perhaps create, along with your current "banned flag", a count of how many times X viewer has been "flagged" (Ex, 3x, 5x, or 10x) and depending on the number of bans, the harassing viewer's Twitch account is frozen for:
"1 week" for 1st offense (flagged for banned 3x)
"1 month" for 2nd offense (flagged for banned 5x)
"6 months" for 3rd offense (flagged for banned 10x)
"PERMANENT" for 4th offense (flagged for banned 11x)
Obviously, Twitch would send said harassing viewer a notification of the number of bans he/she has accrued, with a warning to "stop harassing and abusing Twitch Streamer."

*I strongly recommend you implement this. I've visited many entertaining streamers, and the abusing and harassing trolls is becoming overwhelming, and I've personally witnessed several Twitch Streamers get mentally hurt or insulted by these types of 'imbeciles!'

Since there is really no appeal system to the enforcement process for certain offenses it would seem only fair for there to be some sort of warning system in place for when the system detects an offense. An enforcement system with no warnings and no appeals seems contrary to the best interests of both streamers and Twitch. There is no system to detect infractions that is infallible, and in this case, when an error is made Twitch loses not only a streamer, but the revenue that streamer generated.
An offense that warrants a permanent ban should be taken seriously both by the community and by Twitch. A ban is a potentially life changing event for a streamer with real consequences that can be devastating both financially and psychologically and should be a final not a first step. Permanent banning should be a punishment reserved for the most egregious offences, especially since there is no way to appeal the decision. Permanent banning is supposed to be a deterrent to commiting offenses for the community but without transparency in the process it becomes arbitrary. Twitch should be working with the community to prevent the occurrences of bannable offenses, part of that is educating the community by providing guidance to streamers so they know what behaviors to avoid. It is counterproductive if the community is left to guess at when, how or what offense occurred when an account is banned.
My idea is that Twitch implement a dedicated Enforcement and Appeal branch. This would include some sort of oversight/audit to whatever system of detection is flagging infractions, measuring the accuracy of said system and a way to verify the offenses it flags. Develop fair and transparent protocols for dealing with infractions including requiring human interaction and verification of offenses before banning. Develop forms for keeping records of infractions, allow streamers access to their records. Make enforcement decisions available to public on request. Have a classification system for the severity of both offenses and punishments, determine recommendations for enforcement actions are appropriate to the severity of offense. Determine a system for appealing decisions, have dedicated team to research cases. Treat streamers with respect and fairness. Develop and maintain resources for the prevention of offenses. Maintain lists known malicious items/sites/content. Publish specific criteria used to classify stuff. Develop criteria and method for stuff to have a 'verified' classification.
