Hateful Conduct loophole: Using clips/images of hate symbols and slurs in substitution for your own speech
This is a request for change in policy regarding Hateful Conduct for played media.
Description:
When a user plays prepared media (image/audio/video) with the intent of using its violating slurs or hate symbols to express their own hateful sentiment, this currently doesn't violate the TOS. Meaning, instead of expressing bannable, hateful sentiment with their own voice or body, they play a clip/image instead to carry the sentiment. Essentially, using the media as a substitution to prevent getting banned, while still performing the otherwise bannable, hateful conduct.
This might currently already be a bannable offense for the "hard R" exception, but is confirmed to not count for, i.e. homophobic or trans slurs and that means religious and other protected groups too. Several reports regarding this behavior have been voided by Twitch.
(For Twitch Admin, see reference Report ID: 137691153)
An Example:
[ A gamer gets frustrated at his opponent. Instead of calling the opponent a slur using speech or sign, they instead show a video or image expressing the slur. ]
"Enforcement Notes and Clarifications" might need such an example added in the Community Guidelines.
What this change is NOT targeting:
This change is not targeted at most normal circumstance where speech or symbols are currently allowed by the TOS.
It does not target, i.e. React videos, IRL streams, reporting on news/media, slurs occurring during films/videogames, accidents, etc.
For nearly all content and creators, this change should be seamless and they shouldn't be worried about it.
The change requested only targets a small sliver of offenders:
When the streamer intentionally shows a clip/image with the purpose of using it's hateful expression as if it is their own sentiment.
If you think about it, this behaviour is already partly enforced, in the same way that a streamer can't add hate symbols to channel emotes.
This is done to prevent Chat violating the Hateful Conduct rules by using emotes instead of text.
This change asks that the same kind of enforcement is extended for the media in the broadcast.
