Session Music / Audio Use Waiver
I believe the use of copyrighted music / sounds / audio, may be used IF the streamer signs a waiver to negate ALL reception of donations, bits, and subscriptions (any and all monetary transactions to the streamer) during the streaming session, while that specific session is being used at that time with music, sounds, and/or audio that falls under copyright.
For Example: I want to stream BURNOUT 3 on the Playstation 2, but it has music on there that is originally part of the game. Normally it would be either muted or other action would take place against the streamer, as it violated Terms of Service (TOS). However, since streamer signed the "Waiver", they can now play music during their game session whether it be part of the game or outside sources.
An option or selective action provided by Twitch, can be utilitzed by the streamer after they have signed said waiver to protect not only themselves from DMCA violations, but it would also free up a lot of games to be streamed, as long as said option is clear and concise within the waivers framework.
I truly believe this would help out not only Twitch, streamers, but may produce an abundance of future streamers as well, as it would easily bypass the DMCA issue that is begrudgingly talked about amongst people in and outside of Twitch.
Please consider this idea, as I have high confidence this would be incredibly beneficial to everyone in the future of Twitch.
