1. Beauty & Body Art Community Concerns

   Since Body Painting has been established as a valid category on the platform, there has been a noticeable lack of encouragement from Twitch in creating a healthy community around it. This lack of support is further emphasized by the massive push back and public harassment of Body Painters online, including but not limited to: Organized hate raids by other streamers, Streamers sexualizing body painters on their own live streams, Public groups that organize mass reports on body painters, Lack of response by Twitch to counter the culture of continued degradation of women through objectification by viewers (including inappropriate usernames).

   Twitch has a growing issue on its platform in regards to Body Art, one of its more controversial categories. The streamers of this category are heavily targeted for harassment every day by other streamers and their communities, often leading to malicious mass reports on accounts resulting in account suspensions and bans with little offering as to the specifics of what the offense entails. While the community is grateful for Twitch to include this art on it's platform, the seeming lack of effort to foster a sense of support for the community is disappointing. While it is true that Twitch has offered a recent update to the community guidelines in regards to body painting, they still leave too much up to interpretation. These gray areas leave a number of inconsistencies laid bare on the enforcement of these policies, and leave the streamers feeling a lack of safety in their art. The additional focus, and inequality of these rules being enforced on male presenting streamers as well, also has a play in how the Body Painters are objectified as these guidelines are settled under "****** Content".

   Proposed Solution
   Twitch has an opportunity to lead by example and help to change the rampant culture of ****** harassment and hateful conduct on the platform by showing support for one of it’s most controversial categories. After much discussion with over 100 body painters about the trials we face on a daily basis, we came to a few proposals that if implemented would create a better sense of belonging, safety, security and health in the category. Many of these proposals also have the ability to improve the ****** harassment faced by all females on the platform if expanded on.

   Being as controversial a category as Body Painting is, the community would like to ask for even MORE defined guidelines. There are too many areas that need further definition, such as how long is a short break when painting since the average body paint takes anywhere from 6 to 8 hours to complete? What constitutes performing unrelated activities? How much coverage actually has to be painted before a stream starts (whole ***? Areola/*** and underbust only? Does it need to be detailed or is a single color ok? Do we need to start with the chest as we paint or starting with the face ok?)? As streamers we've seen inconsistency in enforcement of these rules as some streamers are known to show off a pet on stream in a break from painting, some eat while simultaneously painting, and others may take a moment to answer bigger questions on stream. In many of these situations we've seen some people become suspended or banned from the platform when being threatened with reports while live, and others no severe action taken under the same threats. By further defining time limits, expectations of paint coverage to meet, and what is considered a break versus participating in unrelated activities, it leaves little question to the streamer as to what is allowed, and removes some of the discrepancy between how these reports are handled.

   To further elaborate on these discrepancies, we would like to propose that a team of two persons be assigned to review reports against body painters. This can be expanded on to include all ****** content reports that happen live, but is important that there be little room for error when handling these cases. In order to set a precedence for conduct and what is expected, there has to be consistency in the actions taken as well as the reasoning behind those actions. Not only are the guidelines easily interpret-able, but the reasons for suspensions and bans are even more vague and lacking context. If the reports made against body painters are handled by specific staff, that further makes it possible for consistency and clearer definition of the offense when resulting in punishment.

   I cannot stress enough how the platform as a whole would benefit from clearer reasoning for suspensions and bans. While it is hard to give time stamps for the offense in question due to the VOD being removed from the site, it would not be impossible to supply a screenshot or clip with clearer definition of the actions being performed that were against policy. Not only does being clearer about policy enforcement help the community by setting clear precedent, it honors an overwhelming outcry to Twitch to honor its commitment to transparency.

   There is also a great opportunity here to add in a community manager for the creative category with an emphasis on Body Painting. With a community manager, those streaming in Beauty&Body Art would have a designated point of contact when there are questions or concerns about content they wish to produce. Community managers also allow Twitch to have live eyes on the category and better utilize the warning system as things are happening live allowing the streamer to either end their stream or course correct immediately. This line of communication also narrows the ability of more edgy streamers to intentionally misinterpret the guidelines, and would give Twitch staff in Safety and Policy a better view of the issues and harassment going on. This suggestion is one that has been implemented by competitors, including YouTube, who have active community managers that do outreach to streamers and communities while live.

   The list of issues facing body painters is long, and the concern over the lack of support received from Twitch as a category is frustrating. We truly believe in Twitch as a platform though, and the powerful change that can be made in the current culture of objectification and ****** harassment, not only by other streamers but the viewers as well, if Twitch were to take a stance in this controversial category. As a community, we sincerely hope that you will hear our voice, our concerns, and take into consideration our many proposals for solutions. We are open to discussion with policy staff and willing to work to help better the platform as a whole.

   There were some discussions that weren’t super applicable to feedback and I have gone ahead and removed them.

   We super appreciate the feedback and want to keep hearing your ideas. Please just keep it focused on bodypainting/body art community and feedback around that, over feedback on specific channels/users.

   If you have anyone who you are concerned about on Twitch or someone who you are worried about how they are acting on Twitch always feel empowered to report them so our team can further investigate the situation.

2. Allow Nudity

   Since the creation of twitch creative last year, there's been a great community growing. Twitch has made a new and exciting platform for artists to connect with their audience that hasn't really existed before. It allows for such a personal connection between the art, artist, and viewer. When I see artwork from an artist that I watch regularly, not only do I see their beautiful creation, I remember special moments when they completed a section of their work.

   On October 28th, 2015, when Twitch creative was announced on the Twitch blog they wrote, ”We expect to learn much about what is, and is not, appropriate for Twitch as the community grows.”

   After a year of silence, I hope that the community can get some answers and solutions to this important issue.

   For clarity here are the terms of service regarding nudity.

   For Twitch gaming:

   “Nudity can't be a core focus or feature of the game in question, and modded nudity is disallowed in its entirety. Occurrences of in-game nudity are permitted, so long as you do not make them a primary focus of your broadcast and only spend as much time as needed in the area to progress the game's story.”

   For Twitch Creative:

   “We are working on ways to ensure that artists can produce the work that they want, while also fostering a safe space for the community as a whole. We ask that you refrain from creating or using depictions of nudity or extreme violence until those features are implemented.”

   For gaming, nudity can't be the primary focus. For creative, nudity can't be shown at all.

   These rules imposed upon the creative community, cripple creators and the viewers knowledge from such a fundamental core of drawing, the human anatomy. Artists want to share their creative process, including their skills as they improve. How can they improve when the necessary knowledge of human anatomy is forbidden?

   When game designers make a choice to have nudity in their games, the majority of the time it's for sexualized purposes.

   However what the creative community wants is to at least have nudity as an educational tool to build upon our skills as artists to further our understanding of anatomy.

   Today you can view nudity in games, however if there's a drawing thats somewhat suggestive it's a bannable offense.

   Just as flowers, sunsets, and mountains are useful tools in the artist’s toolkit, the unadorned human body can be an essential tool to express the pure emotion of what the artist is trying to convey. Artists use nudity as a tool to focus attention on the human form, and not irrelevant aspects like how their shirts are buttoned, how clothing is being draped, or whether they are wearing the most stylish kind of hat. And if the point of art is to primarily express ideas about the nature of humanity and our role in the world, then it would be natural to expect the nude body would be among the most powerful of those expressive tools.

   Artists deserve the same level of freedom as gamers. To put a lid on our talent diminishes the range of appreciation for the human condition and causes us to constantly edit our creativity.

   I want the artwork I experience to be created with the best training, the most creative ideas, and the widest freedom to use all those things to make the most excellent works that best efforts can achieve. To do any less would make the world a worse place to live.

   You allow gamers to play their games. Allow artists to create their masterpieces.

4. The Issue with the Hot Tub Meta

   Recently in the twitch community, there has been a rise of hot tub streamers also known as the "Hot Tub Meta". This has been a very controversial issue but I'm going to give my thoughts on the issue and hopefully twitch will do something about this. On twitch TOS it's stated "Content or camera focus on breasts, buttocks, or pelvic region, including poses that deliberately highlight these elements". This means any sort of content that deliberately does these would be against TOS. Now when we look at how the Hot Tub Meta we can see that it's unhealthy and unfair to the community. When I was looking through some of the streams a streamer called "Kaellyn" had their butt covering half the screen which I would assume is against TOS but nowadays it's hard to tell. Although the whole stream isn't just that it was obvious that she did to satisfy her chat. Another example is the popular streamer "Amouranth" who lets their viewers donate money to get their name written on many things the most common one being floaty. Just tuning into the chat for a few minutes I saw many twitch users send very questionable things such as "Show feet Kreygasm" "Show your booty" "Change bikini" and many more things. Constantly messages were being deleted by mods because they were either offensive or very ***. Another issue is the fact that it's clear that these streams are *** but the streamers don't even care to put the stream to mature just to get more people. This means that many kids can easily just go onto these streams and see big booba's. It's clear that this issue has gotten out of hand and that it needs to be stopped. My final thoughts are that although this stuff is "content" I don't think it's healthy or fair to the community and streamers to continue letting these streams go on. I think streamers should be able to be creative with their content as well. Hopefully twitch will something about this. Thank you for reading.

6. Regarding the Hateful Conduct Policy, why is Twitch targetting the Streamers instead of the trolls who constantly harass us in every stream.

   I have reported over 600 fake troll accounts and yet STILL Twitch seem to refuse to do anything. NOW we find that if we complain or have a go at these trolls we can get banned ourselves ?

7. Don't allow nudity on Twitch

   This is simply a copy paste of a reply from a recent reddit post on the subject. It's un edited for this purpose but it gets the point across. (Seeing as there are already 2 people asking for nudity, I figured the counter needed a spot)

   I'm a Creative streamer. Long before Creative was a thing. I don't want nudity as part of broadcasts. Why? Several reasons. I run a business. Customers come to my channel to see my work, and one of the problems with nudity is that I don't want my business to be associated with it - Be it fine arts or hentai.

   That brings up the second reason why I don't want nudity. What is art, and what is porn? There's no hard line, and just because something isn't porn or distasteful to you, doesn't mean it isn't for others. I believe that hentai for instance, is porn. But ask any person who draws hentai, and they'll say it isn't. That it's art (The two are not mutually exclusive).

   third reason why I believe there shouldn't be nudity (Read: genitalia). It's an open category with many different streams and people. While GTA is a category with just that one game, and that one audience - It's an 18+ game, in an 18+ category. Creative isn't 18+, and it shouldn't be. There's no good way to allow children browsing Creative with, or without their parents, when there are people drawing dicks in there. (And setting channels to "mature" doesn't do jack)

   Fourth reason, which is more of a counter argument to the idea that Twitch allows plenty nudity already: They don't. Plenty of games are banned from Twitch for the one reason that they display genitalia in one way or another - Recently Genital Jousting, which is a cartoony, and rather funny game in my opinion, about dick-jousting. There's a world of difference between a game character performing a lap-dance more or less clothed, and clearly displayed genitalia. (For the record, I don't think these games should be banned necessarily. They should simply have their own 18+ section - And one could possibly make an 18+ Creative section) An addition to this: Twitch does punish streamers who linger on sexual things in games. It can occur, but it canot be the focus of the broadcast.

   Fifth reason. There's no real good way to moderate this. Even without nudity allowed we've seen countless examples of people crossing the line, be it artful drawing or straight up porn, that have allowed to stream for hours before being shut down. There's no incentive at Twitch to have an admin browsing Creative constantly, verifying that all broadcasts that display genitalia are not crossing whatever arbitrary line Twitch would have to set on "What's porn?"

   Lastly. The idea that allowing nudity would help Creative grow has no real validity. What ever audience may be gained from it, would likely be trumped by the loss of younger audiences and sensitive people who choose to not browse the category, because it shows content they're not comfortable with. This doesn't need to be an ongoing discussion. Twitch is a private company, and they have a relatively strict policy on genitalia (Unlike Youtube that allows for videos of births and Genital Jousting for instance). Can nudity be allowed in a way that isn't detrimental? Possibly. Is it worth it to invest the resources so a handful of artist get to do that one painting they want to do? Probably not. There are so many things to do in art. If you can't do nudity on stream, it's not that big of a deal, in my honest opinion.

   There are art streaming services that allow for nudity, so it's not like there's no place to broadcast this type of content. If anything, I think it's important that we retain a place where nudity isn't part of the Creative process, for the sake of the younger audience, and the more sensitive audience.

   The amount of risky content on JTV back when I broadcasted on there was actually enough to make me not want to share my broadcast with people I knew - It had much looser content guidelines, and as a result, it ended up being something I for instance wouldn't want to show my parents, because you never knew when a cam girl was building up an audience she'd then move over to an actual camsite (They did this a lot), or just straight up porn streams. (Porn streams could run for hours as long as they didn't hit frontpage, so if viewer numbers got too high, the broadcaster would put on a weird clown video or something to make part of the audience leave - The lengths people would go just to broadcast porn was stupid - The issue was well known by one of the mods I spoke with at the time) - I don't want Twitch to risk this being anywhere near a possibility to become the norm on their site.

   Allowing nudity could potentially make it difficult to secure licensing for shows like Bob Ross The Joy of Painting, and the various Food shows. There are likely going to be more of these things in the future, and if nudity has any detrimental effect on securing a deal for these marathons, it's doing much more harm than good.

8. ASMR Category Trouble

   Surely you guys have seen what has recently happened with the "ASMR Category" with two big streamers. Now I will say good job on banning them. But I think those bans should uphold and remain permanent to further back up the message that states. "That type of content is not allowed on twitch"

   It's too suggestive the line was pushed too far.

   Unless you guys want to make an 18+ category or a whole new site altogether adhering to that. Either way some sort of enforcement needs to be put into place. With a CLEAR understanding of what is / isn't allowed

9. Mature Audience Only

   Is there a better way to filter or make sure that if I have my channel in Mature Audience only, that it is understood? Like can we have a little rating setting we can place or have it be better defined in the Topic/Category settings for streams? As well as if there is a way we can make sure it keeps the chat/audience of age?

10. I hereby suggest easing account suspension measures related to bullying and harassment.

    Concerning the issue of malicious individuals using multiple accounts to target specific users in order to abuse the measures mentioned above and force their suspension, I think chat-related issues can usually managed within channel moderation grounds without any active involvement of Twitch, except for the cases in which severe violations occure.

    The current system imposes a 14-day suspension for repeated harassment towards others, which I consider excessive, for it can lead to mumerous mistaken suspensions. Additionally, avenues for appealing these suspensions are limited, raising concerns that users may leave Twitch if this issue persists.

    Many acquaintances have experienced mistaken suspensions, while those who maliciously and falsely reported them faced no penalties. While recognizing the necessity to address trolling behaviour, I hereby suggest leniency in penalties is a more practical approach than the strict enforcement of the aforementioned suspension measures and appeal process.

11. Fairness

    First of all, y’all ban hard working streamers for accidentally opening a page on there stream that they have no control of what is gonna pop up. While y’all have this female streamer being almost fully nude on stream while there is little kids watching, and they get away with almost anything. But as soon as some hard working male streamers accidentally open a link against tos y’all ban them and don’t even send them a email of there suspension? Please make this make sense cause I’m speechless. I have no word to describe how disappointed I am with twitch.

12. Review the Creative TOS, Twitch

    In your own TOS you allow:
    Building construction sets (Lego, Erector sets, Mega Bloks, K'nex, Duplo, etc) or model kits (Warhammer, Gundam, and etc)

    You do not, however, allow:
    Toy assembly

    How do you know that the Gundams etc. Will not be used as toys once they are done? How can you be sure they will not be gifted to a family member and that they will use them as toys.

    Toy assembly should be allowed.

    You do not allow: Unboxing
    But yet many people do unboxing streams (primarly "big streamers")

    You do not allow: Playing puzzles
    But you allow Writing on the same directory.

    You allow: Construction, home building and renovation
    You do not allow: Assembling furniture or Decorating your house. Do these 2, fall under IRL then? If not, consider allowing those as they should fall under the same category as home building or renovation.

    You allow: Licensed Tattooing in a safe, professional environment
    You do not allow: Piercings. Why is that, if done in a safe, professional environment, it should be allowed. They usually do this at the tattoo parlor.

    You need to review your TOS regarding Creative. You also need to review your IRL TOS. And review your site as a whole. Because the above written "Rules" do not make sense.

    Greetings,

    Please keep streams that are obviously deliberately sexually provocative out of just chatting.

    Like a stream I just saw with someone laying on their bed with their butt as the focus in skin tight legging and legs spread widely. They are not even facing the camera. And writing names on their butt for tips. It is ridiculous.

    I am sick of seeing these in Just Chatting. Either force them into a category or don't allow it.

14. Stricter rules against sexually suggestive streamers

    Over the past year or so I've come across multiple streamers creating/streaming sexually suggestive content with the clear intention to arouse viewers and provoke a s*xual response from them for financial gain.

    This is the kind of content you'd expect to see on a p*rn or live cams site for adults, and is totally unacceptable. I've reported a lot of streamers, affiliates and partners for this kind of content and not one of them have been banned or suffered any consequences.

    This gives me reasonable cause to say that Twitch staff who review these types of reports again streamers for this kind of inappropriate content need to be much more strict and less lenient.

    Please introduce stricter rules to prevent this kind of inappropriate content or retrain and review Twitch staff who review reports against these streamers. It would also be interesting to see the diversity among Twitch staff who review reports.

15. Safety: Close Public Access to Past Deleted Content

    Anyone is currently able to access deleted Clips and VODs via a Twitch database that is open and accessible via the stream ID. This is incredibly dangerous, as personal information such as addresses, names, employment, etc., may have been accidentally disclosed on stream, and is now permanently saved for the public to access at anytime, even if the VOD or Clip is quickly deleted.

    PLEASE close this server access to the public for our safety!

16. Allow all games. Remove the prohibited games list.

    The Twitch community is composed of people from around the world, coming from unique political backgrounds and cultures.

    Prohibiting games enforces a specific view of the world to the Twitch community as to what is acceptable or not, censoring content with valuable gameplay and cultural content in the process.

    As of this writing, the list of prohibited games are either due to violence, sex, or any game with the "Adults Only (AO)" ESRB rating. While this could be argued to be a good thing for kids, Twitch has already a "Mature Content" flag in its channel settings for this specific case.

    Responsible adults however are not allowed to take the matter into their own hands and are forced to stream and listen to content that do not fully match their own values. This is in my opinion unacceptable since it hinders the creativity of the video game art form and its economics.

    This is not just limited to the entertainment factor of violent and sexual content, but also derivative content that could not exist without those elements. For example, Manhunt 2 contains in my opinion a very strong anti-violence message in its endings depending on the player's actions throughout the game, but said message does not make much sense without the censored content. Similarly, HuniePop can in my opinion empower shy people to reach out for real life relationships through the tips given by the characters and by gamifying their fear, but would have a lot less impact to them without the naughty rewards.

    Regardless of whether you agree with these opinions or not, the point is that even the most insipid-looking game can have a positive effect to various people, and blocking such games would prevent people from benefiting from them.

    Please allow responsible adults on Twitch to enjoy the content that they want freely.

    The new harassment policy sounds lovely. But, how can we be sure Twitch will actually enforce it? Many of us have experienced harassment from viewers as well as creators (hateful raids, etc) and nothing has ever been done. How can we trust you’re going to do something now?

18. Include DBS checks with affiliate and partner onboarding

    There is nothing currently in TOS that prevents anyone with a criminal record in casting - including people who have been convicted of race, hate or *** crimes. As a private company, Twitch could make the step to update TOS to prevent people who have been convicted of race, hate or *** crimes from casting - and make a DBS part of the onboarding process (a DBS is mandatory for teachers working with children, people in the care industry etc - why not on twitch when children can create an account from the age of 13?) . It wouldn't solve the problem, but it'd be a start - and make it easier for Twitch to remove those who pose a risk now and in the future both online and at IRL events.

    There is a trend for people to stream anime series which not only is illegal, since they don't own the content which has copyright, but this will hurt twitch content creators.

    1. Most of these channels are using an illegal streaming website to stream the show on twitch.

    2. If they are using a legal site (for example, Crunchyroll) they are breaking the law by double streaming their content here.

    3. They are not creating their own content, hurting all hard-working streamers that actually put effort on twitch.

    The problem is there is no easy way of making a report for this case. When a user reports for copyright it sends them to a link with forms that need to be submitted, discouraging people from actually reporting. I think this is why this trend is only growing.

20. Don't ban specific words that are not slurs

    Twitch plans on soft-banning a handful of words in their next policy update, namely "simp", "incel", and "virgin", in an attempt to ***** down on ****** harassment. They say it will only be in cases where they are used as insults but I want to get ahead of this since community outcry is already bubbling up.

    Banning individual words that are not slurs not only lumps them in with genuinely harmful words but also encourages an environment where context is devalued. The above three words are usually used in a joking manner, but I worry that shuffling them into the same category as things like the N word, F slur, etc. will create knee-jerk reactions when moderating; if you're sent a clip of someone saying one of the words to someone and you're unaware of their relationship or their tone is ambiguous, seeing that the word is "banned" is automatically going to push you toward one opinion over the other. You can say they're only going to be banned when used as insults but preemptively sticking a black mark on them leads to bias. Already there are rumors a popular Twitch streamer was banned for jokingly using these words, which, whether true or not, doesn't exactly soothe the community.

    It's also important to note that ANY word can be used maliciously because, again, context matters. There are more childish insults that can still end up being used against TOS if it's done repeatedly and maliciously rather than as part of less-serious trash talk and banter. People get called "stupid", "idiot", and a whole host of other insults (both jokingly and not) but no platform is wild enough to outright ban them. Nevermind niche phrases that can be community-specific (e.g. "blue heart" is a serious allegation in one of my circles) that you'd never be able to ban despite their potential for misuse.

    The upcoming rule also feels biased: there are other "new"(ish) terms that are actually linked to vulnerable minorities that don't seem to hit moderation's radar, yet something that gets jokingly tossed around a lot like simp that is linked to negative behavior is a bannable offense?

    TL;DR Individual words that are not slurs and/or do not have a /serious/ history of misuse should not be singled out in the harassment policy.
