that is a link to Yung Bae on twitter stating that his music will be royalty free, and not subject to DMCA, which indeed does include his Collab music. I have muted audio in my stream despite this fact and that is inexcusable.

  4. I would suggest to go over your existing appeals for muted music.

Two of my videos are falsely muted for 15 months now. I've sent multiple e-mails to Twitch on every possible email I could of find, and every response is that it's not their department to deal with appeals.

  5. Um... so I'm playing a video game. TES III: Morrowind, for heaven's sake. WHY did you feel the need to mute 10 MINUTES OF AUDIO from my VoD when the ONLY music AT ALL is coming from THE GAME THAT I WAS PLAYING??? Sorry, that's fair use. Calm it down over there with your DMCA garbage, you're punishing the wrong people! (Cam girls with rap bullcrap playing faintly during softcore streams, hi?) Fix the DMCA bot. Now.

  7. I had a stream of myself playing piano auto-muted due to an erroneous copyright issue. I was performing Mozart's Sonata in C Major and Mozart's Fantasia in D Minor, and the copyright conflict was for other artists' rightfully copyrighted performances, not for the piece in question that I was performing.

I'm betting that the auto-mute algorithm could be smart enough to know when somebody is performing a piece vs playing from a recording.

Until this is fixed, this feature will disproportionately affect musicians using Twitch to perform works that are in the public domain.

  8. I believe the use of copyrighted music / sounds / audio, may be used IF the streamer signs a waiver to negate ALL reception of donations, bits, and subscriptions (any and all monetary transactions to the streamer) during the streaming session, while that specific session is being used at that time with music, sounds, and/or audio that falls under copyright.

For Example: I want to stream BURNOUT 3 on the Playstation 2, but it has music on there that is originally part of the game. Normally it would be either muted or other action would take place against the streamer,…

  10. Why do you have us use Twitch Soundtrack as an approved music source than hit my game stream with a VOD? You approved the music so why may I ask am I and my stream being penalized for it? YOU need to fix this issue ASAP. I've uninstalled the Soundtrack app because of this and will Never use it again.

  11. I get it...RIAA is aggressive. However, if ContentID can automatically tag and flag a song by whistling the notes, then I would suggest posting a link automatically to "Purchase this song now on iTUNES, Google Play, Amazon, or listen now on Spotify" over muting a stream.

But I know you don't argue with lawyers, you just do it or get sued with them.

  12. Correct me if I'm wrong but cant you just force users to input the song they are listening to on the dashboard (if in twitch music database) this could be aided by a 3rd party application

then have twitch pay the appropriate music producers on a viewer basis (based on percentage to twitch percentage to label) (this could also be brokered if they wanted a top tier musician)

Music producers could run websites like tunecore to distribute their music on the platform

I don't believe all music on twitch must be royalty free

another idea i had is to make…

  14. I just got my VOD muted...for using Twitch Soundtrack. Two separate songs were marked as unlicensed. This is ridiculous, and needs to be changed. How can Twitch promote Twitch Soundtrack as 'the solution' for DMCA takedowns and as a Spotify alternative, if it's causing the exact same issues as any other music platform?

  15. The blanket license has long been recognized as the most efficient and convenient way of clearing copyrights in the United States. It would be time consuming and expensive for you to locate, contact and negotiate with all copyright holders prior to the performance of each song you plan to play.

The U.S. Supreme Court summarized the virtues of the blanket license in CBS v. Broadcast Music, Inc., 441 U.S. 1 (1979) as follows:

"... the blanket license developed ... out of the practical situation in the marketplace: thousands of users, thousands of copyright owners and millions of compositions. Most users…

  16. https://thetrichordist.com/2019/10/19/music-reports-inc-is-tiktoks-copyright-infringement-dmca-agent/

“ Finally I would like MRI explain to its songwriters and publishers, why it is helping TikTok intimidate songwriters and publishers into NOT filing a DMCA notice. It’s right on the TikTok website. TikTok basically says they will doxx songwriters and publishers if you file a copyright complaint. And where will they get those complaints? From MRI.”

  17. You need to implement a faster, more direct way which also allows for a better detailed description from the accused user as your drop down box doesnt cut it. Also how do your BOTS not know what tracks ARE royalty free, i am sick and tired of having my audio muted because of this and then never being unmuted. Given the fact i also pay for Premium, to make sure i get better quality tracks that are 100% DMCA approved.

  18. my vods are being silenced for no apparent reason, at such a rate im overwhelmed and have no interest in appealing each false claim. and with all these updated DMCA measures i can only imagine this is getting worse. i have no "idea" to fix this. because twitch is obviously protecting themselves and theyre in no way incentivized to protect me, nor make this easy for me. so im left to grind out a number of random appeals a week or just stop using the platform.

  19. The whole problem with public performance rights comes from the fact that you're a venue and aren't paying PROs. At the same time, I feel like you're really hurting musicians much more than game-streamers. Please pay PROs like you're required to do. This does not affect VODs or Clips, because that is sync licensing. However, for DJs and other performers, you are very much breaking the law by not having a license with one (or multiple) of the PROs. No wonder the PROs and labels are coming after you, if you won't pay your dues. In the same manner, it…

  20. Create an extension that will allow a streamer to connect to their music source (Spotify, Amazon Music, etc.) and have it as a separate audio stream from their live stream audio (voice/game audio). This would allow content creators and Twitch to simply mute or delete the music stream from VOD's that have DMCA related issues, while allowing the streamer's content to remain available.
