Let copyright (DMCA) strikes expire after 90 days In 2020, many streamers got hit by a wave of DMCA takedown requests for old clips and VODs which affected the streamer's standing.
Since Twitch is currently using a three-strike rule similar to YouTube and other platforms, this put some streamers on the verge of being banned.My proposal is to let such takedowns "expire" after a period of e.g. 90 days, i.e. they don't affect Good Standing after that period.
Since takedowns (regardless of whether justified or not) can appear on years-old content and even live content, this would introduce a fair solution to streamers and Twitch, and is…794 votes -

The current response from Twitch hasn't given these communities many options to move forward. Even giving us with more information on which tracks are high risk would help significantly.

Stop Muting Audio on Licensed Music and FIX the Appeal Process Stop muting licensed audio! If you persist on doing this, at least let people save their appeal form to paste in every time you mute licensed audio! Also, does it really take a MONTH to do an appeal of licensed audio? Can't we just show our license and move? Also, once you clear a track, can't you carry that over so you don't re-mute the next video? This is crazy, and not what the DMCA intended!

Musical extension to limit DMCA problems The musical atmosphere being an important part for the creation of content on the platform, and to limit future problems with the DMCA as we can see now.
I propose an extension (or a feature) in partnership with the main music streaming software that would allow music to be broadcast directly on the live page and not integrated into the video stream.

Private the server Twitch keeps all of the deleted VODs and clips on Evidence of the situation I describe will be at the end of this description.
Twitch streamers are being DMCA'd despite deleting all of their old VODs and clips that they were told to delete. For those that aren't aware, that media never actually got deleted, just taken off of Twitch. Integrating Spotify Playlists with videos to allow for recorded videos to have DMCA music, but not be able to be copyrighted. The Problem:
Streamers split audio to separate their music so they can not be DMCA'd. This means on videos the streams can be very silent where as during the live stream there was music playing. While the feature improved livestreams by allowing for streamers to not have to worry about DMCA with the music they play, but it hurt those that watch videos.The Solution:

Remove Partnership Status for Twitch Partners that abuse DMCA. Do I need to explain this? Do I EVEN need to explain this?
If Twitch Partners are going to abuse DMCA, then there should be some SERIOUS punishment for it. Revoke their Partnerships for anyone who blatantly abuses it and, should the case be a severe one, disallow them from re-achieving Partnership status for a length of time or even permanently (with Affiliation being either harder to attain or also permanently disallowed; again, depends on the severity of the case).

Once Twitch clears a song, unmute it for ALL the streamer's VODs Twitch mutes our VODs, then takes an extremely long time to clear them, yet doesn't clear ALL of that streamer's VODs using the same song. That's problematic for those of us who have purchased a license to use songs yet keep getting muted for the same songs over and over again.

Confirm Dates and streams with Muted Audio One of my recent streams was muted due to "Copy written music" I have been using this same music for over a year now as it is royalty-free music. The song It was referencing was uploaded on Jan 1st of 2022. When I've been using it since 2020. They should confirm the upload dates of the song supposedly being copy-written and confirm those songs are not themselves stolen.

Bans should be of a consequential length Top streamers get banned for less than a weekend for every kind of offense, DMCA included, only to come back and get more attention and money thrown at them for blatantly violating the ToS. What kind of message does it send that nearly every top streamer on Twitch right now has received some number of bans? As it is now streamers might as well get banned on purpose, because currently it's paid PTO with a raise on return to work. Stop catering to the top streamers and actually make your bans consistent and of a consequential length.

Recognize Music Licensing and Add an Option to Put A Music License in to combat future false claims (ie. SOCAN license to broadcast music) Some of us understand fully the legal requirements to stream music, I myself having ran a successful online radio station for 10 years, understand paying for licensing, broadcasting, ect, ect. Make a member Fee for DMCA If everyone who wanted to use recorded music paid a fee, like $10-$20 a month then there should be no issue with streaming copyrighted music.
