Let copyright (DMCA) strikes expire after 90 days In 2020, many streamers got hit by a wave of DMCA takedown requests for old clips and VODs which affected the streamer's standing.
Since Twitch is currently using a three-strike rule similar to YouTube and other platforms, this put some streamers on the verge of being banned.My proposal is to let such takedowns "expire" after a period of e.g. 90 days, i.e. they don't affect Good Standing after that period.

Twitch streamers are being DMCA'd despite deleting all of their old VODs and clips that they were told to delete. For those that aren't aware, that media never actually got deleted, just taken off of Twitch. Make a member Fee for DMCA If everyone who wanted to use recorded music paid a fee, like $10-$20 a month then there should be no issue with streaming copyrighted music. As a Dj i belong to "record pools" where we pay a fee every month to get music. Spotify charges you as well as apple and amazon music so what's the difference. Option to download the original unmuted version of a VOD Have an option to download and/or export the original unmuted version of the VOD, if the streamer wishes to export the unmuted version to YouTube or download the unmuted version to edit out the copyrighted music, so the streamer has an unmuted version for a highlight.
Another potential option is to have the same thing, but make it a tool on the Twitch website (like where the past broadcasts are stored). As in, having the streamer edit out unmuted parts, but make it so they're not just separate VODS- have the choice to merge them together.

DMCA Management Tool With the wave of mass-deletion we have found that the methods for reviewing DMCA claims and taking appropriate action has been like trying to change a light bulb with no hands.
I propose:
Since all deleted content is held in archives, it should become viewable to only the streamer who can selectively re-publish content that does not have DMCA strikes. Furthermore, they can take action to mute content, appeal or delete the content totally.

Appeals process for DMCA strikes and more consistency regarding reprecussions Hi,
My ideas are as follows and some probably already mentioned.
Firstly - I do acknowledge that playing copyrighted music is a risk taken on when it is played, whether it's in-game or nightbot/itunes/spotify or other media player.
In the past, VODs were muted with a red bar on the bottom of VODs to show where copyright-flagged audio was detected.
I would advise going back to this and adding some sort of mouse-over tag so we can see what track/s were flagged and by whom so that it can be contested if necessary to ensure no abuse of the DMCA…13 votes -
Playing Music On Stream Allow creators to play music on stream even if not created by the user or having rights to it but are required to keep it a very low volume. I feel removing the ability for streamer to have background music of their, or viewers choice is taking away the personality of the streamer. It's the copyright holders who are wrong. The fact that copyright holders are sending DMCA strikes for people who are listening to music during their stream is absurd. It's commercially absurd. It's ethically absurd and its practically absurd.
First of all the behaviour by publishers is completely against their own interests and is completely ignorant of how people consume content on the internet. This isn't surprising given that these industries are essentially dominated by boomer dinosaurs who used to sell us CDs at 30 dollars a pop (30 dollars in the 90s).

Presumption of innocence Apply the principle of presumption of innocence, as every respectable legal system does. Why, after a copyright claim, do you immediately take down videos or parts of the content or even ban the streames, thus automatically siding with the claimant? Youtube and other services doing this does not make it in any way right. Consider first giving the streamers a reasonable period to defend themselves, and only following on any action after the streamer has been heard and did not make a compelling case for themselves. Database of Common Strikes linked to game library Create a database of commonly struck games that links with Game library on the dashboard. Then have a warning that displays when a streamer changes category to a game that is commonly struck by the game's (or music creator's) rights holder(s) so a streamer is aware and ready to deal action AFTER or make plans before.

Actually respond and have a place for attachments when filing an appeal Months ago, I filed for an appeal on another twitch channel I run and I never got a response. There’s no way for me to contact about being updated. Also, when filing the appeal, there was no way for me to attach proof that I had permission from the artist to use their song. So, attachments when filing an appeal needs to be a thing. And again, I never heard back so that part of the one video is still muted despite appeal being filed months ago and having the artist’s permission in writing

Restitution for streamers unfairly banned/lost years of content Twitch should find a way to reimburse or provide recompense for the unfair and extremely short timeframe to deal with their VODs. Many streamers lost years of content because they simply didn't have time to download and archive their VODs, which is absolutely unacceptable in this industry. Twitch has acknowledged that they screwed up, so let's hear them state what their plans are for making it right to those negatively affected.

Alternatives to suspensions for DMCA DEAR READER(S),
There needs to be an extension in the amount of time content creators are allowed to fix or remove disputed content.
BANNING AN ACCOUNT out right is uncalled for considering other rightfully banned accounts that are intentionally uploading and maintaining disputed content without multiple warnings and flags in place as well as assistance to edit and/or remove content.

Remove Partnership Status for Twitch Partners that abuse DMCA. Do I need to explain this? Do I EVEN need to explain this?
If Twitch Partners are going to abuse DMCA, then there should be some SERIOUS punishment for it. Revoke their Partnerships for anyone who blatantly abuses it and, should the case be a severe one, disallow them from re-achieving Partnership status for a length of time or even permanently (with Affiliation being either harder to attain or also permanently disallowed; again, depends on the severity of the case).
